1. Agreement to Terms

WonderPods💫 (the "Service") is operated by Crespo Ltd. By accessing or using the Service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Service.

2. Use License

Permission is granted to temporarily access and use the Service for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose
• Attempt to decompile or reverse engineer any software contained in the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Account Terms

To access and use the Service, you must:

• Be at least 18 years of age
• Complete the registration process
• Provide accurate and complete information
• Be responsible for maintaining the security of your account
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Payments and Credits

WonderPods💫 offers credit packs for purchase. Credits equate to approximately one minute of episode duration. Credits are valid for 1 year from purchase. New users receive a free trial of 7 credits for 7 days. Your episodes and playlists remain accessible for 1 year from your most recent purchase. After 1 year without a purchase, access to episodes is revoked.

5. Content Generation, Usage, and Ownership

WonderPods💫 uses AI technology to generate personalized educational content. By using the Service, you acknowledge that:

• Generated content is for educational and entertainment purposes only
• Content accuracy and appropriateness may vary
• You are responsible for reviewing content before sharing it with children
• We reserve the right to modify or remove any content at our discretion
• You do not own the episodes created through our Service, but rather have a limited license to listen to them while your account is active
• You may share the episodes you create with friends or family for non-commercial purposes, but you may not sell, alter, or claim ownership of them

6. Content Moderation

WonderPods💫 moderates content to ensure age-appropriateness and safety. We may:

• Monitor and filter generated content for inappropriate material
• Block content generation that violates our community standards
• Temporarily or permanently suspend accounts that repeatedly attempt to generate inappropriate content
• Customize content based on the child's age to ensure age-appropriate material
• Filter out and block any attempts at prompt or code injection that could manipulate our AI systems

7. Intellectual Property

The Service and all original content, features and functionality are the exclusive property of WonderPods™ and/or its licensors and are protected by copyright, common-law trademark, trade-secret and other applicable intellectual-property laws. No license or right is granted to you except as expressly set out in these Terms.

8. User Content

When you submit input to the Service (for example, a child's name or custom prompt), you grant WonderPods™ a non-exclusive, royalty-free license to use that input solely to operate, maintain and improve the Service. WonderPods retains ownership of all AI-generated episodes and grants you a personal, non-transferable license to access and share those episodes non-commercially while your account is active.

9. Prohibited Uses

You may not use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Prohibited activities include:

• Harassment, abuse, or threatening behavior
• Posting inappropriate or harmful content
• Attempting to gain unauthorized access to the Service
• Interfering with other users' enjoyment of the Service
• Using the Service for commercial purposes without authorization
• Deliberately attempting to generate inappropriate content for children
• Circumventing our content moderation systems
• Attempting prompt engineering, code injection, or other techniques to manipulate our AI systems
• Deliberately testing or exploiting vulnerabilities in our AI generation system

10. Privacy and Data Protection

We collect and process personal information, including children's names, ages, and hobbies, to provide and improve our Service. By using WonderPods💫, you agree to our Privacy Policy and acknowledge that:

• You have the right to access, correct, or delete personal data we hold about you or your children
• You can request a copy of all data we hold about you
• You can withdraw consent for data processing at any time
• We implement appropriate security measures to protect personal data
• We only collect information necessary to provide our Service
• We comply with applicable data protection laws including GDPR and CCPA

11. Marketing Communications

By creating an account, you consent to receive marketing communications from us, including offers, updates, and news about our products and services. You can opt out of these communications at any time by:

• Using the unsubscribe link in our emails
• Updating your communication preferences in your account settings
• Contacting our customer support team

12. Disclaimer

The Service is provided "as is" and "as available" without any warranties, either express or implied. WonderPods💫 does not warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, WonderPods'💫 total liability for any claim arising out of or relating to the Service is limited to the greater of

• (i) the amount you paid to WonderPods💫 in the twelve (12) months prior to the event giving rise to the claim, or
• (ii) US $100.

WonderPods💫 shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after such modifications constitutes acceptance of the updated terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware (USA), without regard to its conflict-of-law provisions.
